President-elect Donald Trump has again turned to the courts hoping they will step in and stop his sentencing in New York on a 34-count felony conviction, which is scheduled for Friday.
Associate Justice Ellen Gesmer of the Appellate Division, a mid-level state appeals court, made the decision after holding a hearing on Trump's last-ditch effort to block the trial judge's ruling on Monday to proceed with the sentencing, scheduled for 10 days before his inauguration.
Trump is seeking an emergency order that would spare him from being sentenced while he appeals Merchan's decision last week to uphold the historic verdict.
Trump was found guilty of 34 counts of falsifying business records in the Manhattan case in May 2024.
