Donald Trump's legal team skipped a key step in blocking his upcoming sentencing in New York, misrepresenting its efforts to appeal the hearing that is scheduled to take place 10 days before his inauguration.
Trump’s lawyers turned to the nation’s highest court Wednesday after New York courts refused to postpone the sentencing by Judge Juan M. Merchan, who presided over Trump’s trial and conviction last May on 34 felony counts of falsifying business records.
A hearing is expected to be held today on Trump's attempt to block his sentencing on state felony charges.
Trump’s emergency application asks the court to prevent the prosecution from moving ahead until his appeals implicating presidential immunity are resolved.
